Sign or not, you must come to a complete stop when entering a roadway from a driveway, parking lot etc.

Was the stop sign on private property? If so, did the owner give permission to have it put there with the intent of it affecting the traffic in and out of their driveway? How far up the driveway was the stop sign? In most states the government has what it refers to as right of way. This is the first 3-6 feet of land on either side of a public road. The government reserves the right to use this land for any reason to improve the community. If the sign is within the allotted distance, then you cannot have it removed. If it is further than what your state allows for an easement, then they must get the permission of the owner. Also, in most states it is common law that a driver must come to a complete stop at an intersection where one roads dead ends into another such as a driveway. Some states do have laxed laws that allow for yielding only if the street is not congested. Find these out and if you were in the wrong, admit it.

BTW, just because you did not "see" the sign does not mean you can ignore it.

i do not know about that a stop sign on private property is not enforceable..but your state might be different. in the two states i have lived in, you would not get a ticket

I don't know about where you live but here in Missouri a private property stop sign is not enforceable

You have two choices now according to law. You can either pay the ticket or you can go to small claims court and bring evidence that it was not your fault, but make sure you have lots of good proof and they will let you off this time esp. if it's one of your first tickets. Good luck-Your Friend.

why didn't u see it? was something blocking it(trees, bushes)? You could take pictures of the blockage and show judge maybe it will be dismissed???
