country so when I complete my taxes I select married and add my husbands first and last name with no SS number because he does not have one so then I am told I have an error on my file (e-file) because I did not add his SS number and there is no way it lets me continue without the number and now I don't know what to do. Can anyione help me with this problem?

You can not file with him without a SSN or and ITIN , he needs to complete form W7 and submit the tax return, the W7 application and documention required with the W7 to the Philadelphia Service Center, If he qualifies for the W7 the IRS will issue a number and process the return including his number, You can not file electronically,

He MUST have an SSN or ITIN for you to file a joint return. He must also agree to allow the US to tax his world-wide income for you to file a joint return with him.

If he agrees to this, here's how to proceed:

Prepare your return, leaving his SSN blank. You must file a paper return. Attach a Form W-7 to the return. Your husband must prepare and sign the form. He must attach proof of identity to the W-7. Attach a joint statement signed by both of you agreeing to have your husband's world-wide income taxed by the US. Make sure that your return includes any income he had from outside the US! When you file your return, the IRS will process the Form W-7, apply his ITIN to the return, and then process the return.

You only need to apply for the ITIN number once. But in future years you will still need to attach the joint statment to your tax returns until he becomes a US resident. Once he becomes a US resident, his world-wide income is automatically subject to US taxation so the statement will no longer be required. The requirement for the signed statement means that you cannot e-file until he becomes a US resident.

If your husband refuses to be taxed on his world-wide income until he becomes a US resident, you must file as Married Filing Separately. Put his name in the appropriate space on your return and write "non-resident alien" in the SSN space.

In order for you to file either joint or separate, your husband needs a SS# or ITIN#.

If he does not have and is not eligible to get a SS#, then he must apply for an ITIN. For instructions on how to do so, see Form W-7 and its instructions. It usually takes about 4-6 weeks to get an ITIN, so I recommend he do this asap.
