They can't kick you off the plane - that would be murder, and opening the door would be dangerous for the whole plane.

The couple's lawyer claims that the couple was not engaging in sexual activity, but that the man was sick and resting his head on the woman's lap.

A lot of it has to do with the flight crew. If they discover what you're up to they have the option of informing the captain so he can decide if he wants to have authorities meet you at the gate, or they can simply ask to to return to your seat. However, if a member of the flight crew asks you to return to your seat and you don't, then you could be arrested upon landing for failing to comply with crew instructions.

The BBC ran an article investigating whether sex on a plane was legal. Their conclusion was that it would depend on many factors, such as whether or not the act occurred in sight of others. Also, for international flights the law could vary depending on departure and destination cities, what country(s) was being overflown at the time, and the nation of the carrier airline.

Well it would vary depending on the sense of humor of who catches you. You could get giggles or a reprimanding look or you could get a jail sentence if you got reported!

In all cases, it is not worth it. If you really want to do it, hire a private plane that has a proper bed in it and joint the club at your leisure! ;)
