This question was asked and thankfully good answers were received."Can legal action against Hospital succeed ? A person got his wife aged 49 admitted into a hospital with the complaint of severe chest pain. She died in about four hours. No ECG was taken though it was prescribed. She was sedated and yet she was made to walk through corridors to a washroom. There was no history of any prior heart complaint."
Is it likely that the doctor will strengthen the case against the hospital in his concern for defense? Can he claim legal costs if he is acquitted of any wrong-doing?

Standard of care is important in medical malpractice suits because to be held liable, a doctor must not only cause injury, but the injury must result from not following the "standard of care." A standard of care holds a person of exceptional skill or knowledge to a duty of acting as would a reasonable and prudent person possessing the same or similar skills or knowledge under similar circumstances. In other words, a health care provider's actions are measured against the standard of care active in the caregiver's location or similar community.
There has been a gross negligence on part of Hospital since no baseline Investigations were carried out i.e. ECG/EKG, Tropin/Trop T, nor were cardiac enzymes tests were carried out.
Your statement that she had no cardiac disease, holds no value.
Last is the post mortum/autopsy report!! What are it's finding findings than only can you sue up the entire hospital.
