We actually had a discussion about this at our organization recently. What we found out was that it depends on the state that the individuals live in. California has a specific law set down specifically mentioning HIV/AIDS. Here in Kansas there is a law that is non-specific just mentioning 'life threatening communicable diseases'. Both of them require 'disclosure prior to exposure', the infected person would have to tell their status before insertion. I agree about the moral argument though. If you KNOW you have HIV you should tell your partners.

Of course many do not. However, I heard of two cases where people knew they had aids and gave it to their partner and the partner dies. The transmitter was charged and convicted of murder.

by law, the person who has HIV are supposed to inform the health department for various reasons. but for me, the most important reason in that list is to educate that person about his/her condition. as to his/her partner, i think he/she owes it to his/her significant other to tell. if he/she does love his/her partner, informing them of this life-altering situation is the right thing to do.

No but it would be polite to. And if you dont know someones complete sexual history, and the history of all the partners they've had, you should be using condoms.
