No. You should not even call him a criminal. Like in the novel by Victor Hugo - Les Miserables where Jean Valjean spends 19 years in jail for stealing a loaf of bread. Inspector Javert who pursues Valjean relentlessly, and finally arrests him. Having seen Valjean in his intermediate life as an almost saintly person Javert releases him but cannot forgive himself for breach of duty, so commits suicide. A book of this stature with such poignant expression must make us all think that prisons are for criminals and not for punishable mistakes made by innocent people in dire need.

I'm not sure where you live, perhaps Saudi Arabia?
In the United States, it is almost impossible to do prison time for a crime that doesn't involve a firearm or a huge amount of drugs.
I realize people go to prison every day, but it is almost never for a first offense, or a "small crime" unless they have an amazingly bad record.
If most people really knew how lenient the judges are, and how minimal the sentencing grids are that they use in my state, they would flee for their lives.
So, when you ask this question, I wonder, did someone give you a sob story and you fell for it, or was someone the victim of incredibly bad luck?

no crime is a small one. whether it is an small robbery of 100Rs. or that it is an murder one. crime is afterall a crime. it should therefore be noted that each and every criminal if does not serves his time in prison then he should atleast be given the punishment that shall satisfy for the offense done by him.

If not then where is the criminal to go? He/she can't be left free in society to repeat the same crime again, without repenting for the crime that they have already committed.

No. he should not sent to jail, because in most cases the environment tends to make him the sin.all are not like that but somepeoples. so, he must given proper counselling.IF A PERSON KILLED THRE PERSONS HE SENT TO JAIL(for e.g.only).what we have to do for TERRORIST,they had killed more than 100 peoples @a time by placing a bomb, they are all kept in prison for 10 years &released.so,keeping in prison doesn't change one's mind.he become lazy after returning 4m d jail.so,he makes mistakes again&again.

If we didn't lock up the people that can't afford a defense, then how would the DA get those notches on theirs belts, how would the prisons make all there millions. We can't afford to lock up people that deserve it, so I say that we should lock up all the J-Walkers, and those people that don't use their turn signals.

What's one man's small crime is another man's onerous burden.

Theft under $500......small crime?
What if it was your grandma's pension cheque and she had to buy groceries and pay the rent and had no one to turn to.....still small crime?
