The cheetah would catch the human well before the finish line, and settle down to eat. Therefore, nobody would win the race, since they never reached the finish line. From the survival point of view, the cheetah would win, though.

The cheetah has a speed burst of up to 60 MPH but only for a very short period. The marathon runner still would not stand a chance.

The operative word is CHASE not race so I'd consider being eaten would make the marathon runner a loser. No way she could out pace the cheetah!
