My son was dating a girl , she got pregnant. When the child was born my son, trusting soul, signed the birth certificate. Now, due to recent information, there are some serious questions as to whether he is the child father..and she has left and took the child. If a paternity test is taken and it shows he is not the father is he still responsible for the child?

Thank you all, there were some real good answers. I have figured out the "trick" now, ask after the 12 year old kids have been put to bed. LOL

That would have to depend on the state you live in and the laws they provide for such a situation. In many cases, if the father signs the birth certificate..he basically is saying he IS the father. Now if questions arise and there is doubt that he may be the father..a paternity test may be needed. Best thing to do is find out what the laws are in your state and talk with a lawyer.
If you dont want to get into legal matters right away and just need a test for "peace of mind"..there are many websites that offer the home paternity test..they can be costly but are very effective. It usually asks for a mouth swab from the child and the father and you just send in the swabs to their lab and bingo!! they will have results for you.

If he signed the birth certificate...he is legally responsible for the child. He needs to get a lawyer and demand a paternity test. The best thing to do is go through the courts. If he is found not the father..than he can have that changed...but until he does, he has to support that baby financially.

Yes as long as he signed that birth certificate. In the law eyes he still would be the father. But if they take a paternity test and the baby is not his. If the girl knnows the real father ,she can have him take a paternity test. And they could get an attorney to take your son off the birth certificate and put the real father on there. A family law attorney. Could be expensive.

You can't responsible for someone else mistake! when he signs the birth certificate because he thought that was his natural born child, he accepted the responsibility by signed the BC. Now the test proved that it wasn't his child, no such laws required you to responsible for that..The girl has left, did she wants any child support? if she's not asking for anything..then why so bother! If that really is his child..then accepted the fact and take care that innocent child..like a man! Also, is he still loves the girl? if he is, then forgive her, accept that innocent child and live together.

because of the fact the organic and organic father has not shown any interest in his newborn (no taking part in cards on birthdays, no help being paid, no petitions to have partial custody of the newborn) then you truly might desire to record a Petition for Termination of Parental Rights and cite all those issues that practice he has no interest and has on no account had any interest interior the newborn for all this time. as quickly as the court docket provides the petition you will have the non-organic and organic discern undertake the newborn and he will then have each and all of the household initiatives any organic and organic discern might have with their very very own newborn. The organic and organic father will not have any declare on the newborn nor will he be paying any help the two.

In most states yes. Once a man signs the birth cer. he is taking up reasponsiblity for that child. Nost judges will not look past that.

No he would not be responible for the child. He could request his name taken off the birth certificate. I had this happen to a friend of mine and he petitioned the court in order to take his name off of it.

depends on the state but basically in most what it comes down to is if she coerced him into signing a "contract" under false pretenses he is not responsible(only if its not his).
I would insist on a dna test then if its not his sue her for the child support he paid. unless he has a desire to be the babys daddy then ignore it all and assume its his and go on with life.
