I am an American citizen married to a Filipino and she is pregnant. If we have the baby outside the US (say in the Philippines) will the baby be a US citizen? If not, can we do some type of paperwork to eventually make this happen?

This would be a sticky situation. Only 5 countries in the world allow automatic birthright citizenship. (meaning if a baby is born in the country, it is automatically a citizen). The child is not automatically a US citizen. Too many people assume it is automatic if the parent/s are US citizens. It isn't. If at least one parent can prove they meet the residency requirements then they can pass on US citizenship. This usually means they have to prove they have lived at least 5 years in the US, 2 of which after the age of 14, prior to the child's birth. They will have to prove this when the register the birth abroad. If they cannot prove the residency requirements, then the child would not be a US citizen.

Yes. You must obtain an international birth certificate from the Philippines and contact the US Embassy to register a birth abroad. You can apply for a passport at the same time and your baby will also get a social security number/card. You will however have to prove that you lived in the US for at least 5 years and that you yourself are a citizen. The both of you will also have to apply at the embassy, in person, with the baby.

Yes. In most cases, a person is a U.S. citizen if all of the following are true:

* One of his or her parents was a U.S. citizen at the time of the person in question's birth;
* The citizen parent lived at least 5 years in the United States before his or her child's birth; and
* At least 2 of these 5 years in the United States were after the citizen parent's 14th birthday.

A person's record of birth abroad, if registered with a U.S. consulate or embassy, is proof of his or her citizenship. Such a person may also apply for a passport or a Certificate of Citizenship to have his or her citizenship recognized.

Your baby should be a US citizen. He or she would also probably be entitled to be a Philippines citizen. The US Embassy in the Philippines will have more information.

Yes so long as at least one of the parents is a natural born or naturalized citizen of the United States.

Yes, you need to be on the birth certificate as a parent though. One of my friends had a vindictive mother who refused to put the father on the birth certificate and now he's stuck in Germany doing his mandatory military time when he really should be a U.S. citizen.

yes. any baby you have will be an american citizen. you'll have to contact the consulate soon after the baby is born. i'd look it up on US government sites so that way you know what you need to do.

I'm sure that it's entirely possible to select the nationality of a baby born to parents of different nationalities.
Your best advice is going to come from the US Immigration Department. Contact them through their website or by phone and they will be able to advise you on how to ensure your baby is recognized as an American Citizen.
