Im confused on whether this would be considered sexual contact and illegal. Consider age of consent being 17. My initial guess would be no. I'm referring to a peck not a full blown makeout session. Thought about this reading my NYS Penal law.

No I have no intentions of doing so. basically it comes down to is if kissing is sexual contact. I'm a law student trying to figure this out.

It depends on several factors; one being age..in the State of New York the age of consent is 17.

However...

The other factor would be whether or not the kiss was consentual or welcomed, even if it was just a peck on the cheek.

Currently, in Waterbury, CN there is a case where Ralph Crozier, 55, an attorney, was arrested for kissing a female judicial marshal at Waterbury Superior Court on Dec. 22. The marshal told police she did not invite the kiss, which was why a criminal disorderly conduct charge was filed. He is claiming the kiss was only a "peck" on the cheek as a gesture of wishing her Happy Holidays.

If it could be construed as sexual contact in any way shape or form it could also be considered illegal. Kissing is often a sexual act, even if it does not lead to intercourse.

How would you justify it to a jury that a worldy 21 year old was kissing an immature 16 year old. It just wouldn't work.

Yes, it's inappropriate sexual contact between an adult and a minor. Many states give a two-year separation in age, but in this case it is 5 years, involving an adult and a child. Sounds like a no-no to me. No confusion here. Why would your guess be no?

Regarding your details:

Remember the case of the 6 year old in Lexington, N.C who was suspended from school for kissing a little girl on the cheek? When she ASKED him to, to prove his friendship? He was suspended for sexual harrassment. Yes, ridiculous, but that's what they called it!

I would say be VERY CAREFULL. I would not touch anyone under the age of 18 if I were 21 or older, then I would want proof of the age by asking the parent right in front of the kid what yr they were born etc.--------too many are getting in trouble for something that was very innocent to begin with.

IT"S illegal. You be going to jail and that's real talk. Kissing is considered sexual. Basically, you are making sexual contact with a MINOR. It's not jail..but PRISON. You be away for a year i believe or more.

If it is between a teacher and student, yes it would be
illegal. If it is between two consenting people in a non-public place,who would even know they had a little peck between
them? Use common sense.

Well dude its just a kiss. I really dont think its something that would come up. I personally made a rule that you dont kiss her over until she kisses you under.

only if you get caught. seriously,if it was like just a hug and a peck on the cheek(and it was welcomed) it would be legal.

No. As long as there was not any kind of sexual contact like oral sex or penetration then it is not illegal.
