If you live in a state that has sales tax and a vendor doesn't charge you tax, then "use tax" is due (at the sales tax rate) and you are responsible for keeping track of this. Most states have a line at the end of their state income tax forms where this tax can be declared and paid. Since the amount is usually small, states don't normally come after individuals who don't pay this tax, but legally it's due.

If you're a business and you fail to keep track of the tax and pay it, the state sales tax auditor will come knocking at your door and charge you interest and penalties for failing to pay the tax.

Usually it depends who is selling the item and where they are located. For example, a company selling in California probably charges sales tax to buyers in California, but may not charge it to people in other states. In order to charge tax, a person needs to be set up with the government to collect tax. Individuals selling their personal stuff on E-bay are not likely to fit this description.

n2js gets my vote for 'best answer' so far. This applies when buying from an on-line store. If the seller is conducting an 'on-line yard sale', I'm not sure taxes are due.
