what are your rights as a home owner. This happen a few days ago to my parents and even though the officer did not have the warrant on him he forced his way past both of my parents, who are 80 and 73 knocked them both to the floor and then forced my Dad (80) to stand outside in the freezing rain and arrested my Mom (73) for assault because as she fell she touched him.They had no search warrant but dumped drawers out into the floor and then threatened to shoot their dog because he was trying to protect them. The cop did not even knock on the door before he entered just opened the door and entered. We later found out that the so called warrant for the other person was a misdomeaner warannt that had been withdrawn 5 days before. We were told that if there is an arrest warrant that they have the right to enter and home and search anything as they see fit. They held my mother for 24 hours with no charge and would not even allow her to call and refused her medication .

She has glacoma and had just had eye surgery and is hypo-glycemic. i was even told by the deputy not to call the jail after I had called to try to find out what was going on. Please some one help!

Your parents should definitely pursue this. I would start by calling the local media to draw attention to the issue. If you have a law school near by you can ask them for places to go for free help. There are all sorts of public interest groups to help people who cannot afford attorneys. If they can afford an attorney, they should definitely call one. I'm not sure what can be done through the courts, but at least they can try to get disciplinary actions taken on the two idiots masquerading as "peace officers".

Police with an arrest warrant may enter and search the premises without the permission of the owners. In certain cases they may enter without announcing themselves.
Police may also hold someone for 24 hours before charging or releasing them.
Now if in fact the warrant was withdrawn 5 days earlier, and if it was in fact a misdemeanor warrant, then the search can be deemed to be unreasonable search and seizure. Call the ACLU, and ask them if they can help you. Expect the police will have a much different take on the case though.

Of course, what happened, if it happened at all, didn't happen the way it has been described.

And I'm just a little ashamed that I spent this much time responding to what is clearly a fabricated story. All of [you other] responders ought to feel silly, too.

sue the police station becaue they would have to knock and ifit was dissmissed 5 days be4 then its trustpassing so get a good lawyer and get money becaue F@cK the police

Photograph all evidence immediately, scars, trashed house everything.
Then call legal aid.
