My wife and I are moving out of state , I will still be working for the same company but they promised to have my w-2 to me with my last check of december or the first week in ( I know they have until the 31st legally) jan because for a while we'll be in a hotel. I have my w-2 from last year, don't do penison or get health deductions...so would it be a issue government wise if I filed without having my w-2? I mean I don't want to get into trouble but I also need to file soon , since my bank account is going to close and we'll have no "home" address yet. Thanks!

I am going to e-file it myself, through a website and I don't need to send it in, just keep them for records. I did it last year but waited for my w-2.

It is perfectly legal to file with your last paystub...assuming the information is accurate.

In the worst case scenario, if you get your W-2 at some point and something is different, make sure you file an amendment (1040-X) to correct your taxes. You have 3 years from the date you file your original return to amend it.

Legally, the e-file provider must obtain your W-2 before transmitting your return to the IRS.
