If you approach a bus from the rear, stopped at a railroad , on a four lane street with only his caution/amber lights on and the driver is only checking to see if the tracks are clear. Can you legally pass this bus in the left lane of this 4 lane street? The speed limit on this street is 35 MPH.

Yes, as long as you signal and maintain a speed within the posted limit. The bus driver is required to stop and check for oncoming railway traffic but is not picking up or discharging passengers, therefore you can legally pass. The only time you cannot pass a bus is when it is displaying a flashing red signal, then traffic going both ways must stop. Typically this only applies to school buses.

First: the bus is required to stop at the railroad crossing and open his door to listen. He is supposed to turn off the master switch which turns on the crossing lights before opening the door. He is supposed to have on his red 4-ways located at the center back of the bus, not on top where the crossing lights are.
Now: Yes you can pass the bus if it is safe.

NO!...NO!...NO!...

You must come to a complete stop at once and wait for the bus driver to switch his red lights on them wait for those lights to turn off, then you must wait for the bus to clear the tracks...only then can you drive on...but NO PASSING at any time!

There are "no passing a school bus at ALL times" laws in ALL 50 states...please obey yours!

having been a bus driver myself at one time you can pass me at anytime unless my red lights are flashing. but i advise you to do it cautiously when you do just to be on the safe side.

Yes you can. I believe the red lights flash when they stop to pick up-drop off kids anyway, don't they?

Amen, I attempt each day now to not evaluate. at the same time as i detect myself slipping I scold myself. continually contained in the decrease back of my recommendations is "choose not lest ye be judged" thanks for sharing this it helps to remind us all to do a touch better.

i believe you can as long as the stop sign is not out and they arent letting kids off the bus
