I had every intention to complete the agreement to sell my car but it didn't pass smog and the buyer is harassing me saying I have to pay for the repairs and still sell him the car at the agreed price. I have been told the agreement is void since it would not pass smog but he is continually harassing me and threatening to sue me. Does anyone know whether or not I have to do as he is threatening?

In good faith I agreed to sell a car for x amount of dollars believing the car would pass smog. It did not pass. Is the agreement still valid? Am I obligated to fix the car and sell it to him even though it didn't pass smog? He gave me no money in good faith just the agreement we both signed and now he is harrassing me calling, faxing, and threatening me if I don't sell him this car. I just want to donate the car to charity at this point but don't know if I am legally obligated to him or what to do.

Unless you have a written agreement that says that you will sell him the car for X and you will warrant that it passed the smog test, he can not force you to sell the car! If you did sign an agreement, did he pay you anything?

For a contract to be valid, there must be a meeting of the minds, meaning that you both have agreed to all points, and there must be some valuable consideration for the contract (usually money changing hands)

Tell him that if he continues to harrass you, you will sue him! Turn the tables on him!

did you make a sales reciept stating you would cover smog ?dealers are required . not sure owners are . AS IS reciept would been best !
