Are you asking a botanical, culinary, or legal question?

Botanical:
Not only is the tomato a fruit, it is actually a berry!
Cucumbers are a variant of berry called pepos.

Culinary:
All are vegetables. Tomato and cucumber are savory in flavor and usage and therefore are treated as a vegetable.

Legal:
The tomato is legally a vegetable. The US declared it a vegetable for tariff and taxation purposes in 1893.
