The difficulty you face is in the collaborative evidence. How many people can attest to your claims? Being a physician, I realize that with a death, everyone seeks to find fault. However with a malpractice suit, the burden of proof is in the hands of the claimant...so it is your obligation to show that neglect, malfeasance or malpractice was committed. Both the hospital or doctors are held to be innocent until the contrary is shown.

If an investigation leads to the negligence of the hospital, then they can be sued for malpractice. Many cases are successful since hospital personnel, though sad to say, aren't always perfect.

These cases are difficult. There is so much secretiveness and cover up on the part of the hospital/doctors if there was any wrong doing. If the husband is strong and driven, he should follow his heart and pursue it. If it will just upset him more, he should drop it. It won't bring his wife back and no amount of money can restore what you've lost.

If you can document the treatment, or lack thereof, then yes, a legal action against a hospital can definitely succeed--they may even settle out of court.
You need to talk to an attorney to find out if you have a case, though.
