IF you drank after him/her when she was having an outbreak and you got some of the infectous residue on your skin then you run the risk of contracting it. If you just drank after this person and maybe shared some saliva? You shouldnt worry. I dont think you can get it that way.

It depends if you have been intimate with them or share a drink or smoke and what type of herpes it is simplex 1 or 2

There are many types of herpes. If he had a sore on his mouth it is possible but usually it is direct contact. As for the other types, no, you won't get them.

Cancer sores are a form of herpes, now you could get a cancer sore possibly if he had one, but genital herpes through drinking out of his cup, come on now, absolutely not
