if lets say, a family overseas entered the US LEGALLY with a visa. They planned to stay here with their visa, so technically they are legal. but their visa expired and they are waiting for their papers to go through.
They pay their taxes, they have an ITIN number which they use for ID, don't get any kind of benefit from the government, their kids are paid for school. they learned the language better than the average American. They try not to be a burden to the government, and don't have any criminal record whatsoever.
would you consider them illegal immigrants?

I guess it depends on your definitions of "illegal" and "immigrant" and how technical you want to get.
According to the laws of the United States, they are here illegally and should be sent back where they came from. Overstaying a visa is illegal in the same manner as someone who crosses the border in the middle of the night.
However, since the initial immigration was legal (visa), they are ahead of the border-jumpers, as at least in the beginning they came here under legal pretenses. And if they have papers in the works and are just waiting for the visa to be extended, again they are doing things the right way, even if their presence in the US is technically illegal.
I would much rather have people here illegally because their visa ran out than people who are here illegally because they snuck across our borders. At least if your visa ran out, it means that you started out trying to do it the right way. The border-jumpers just said screw doing things the right way, they're gonna do what they want, and to hell with international law.

Even though they are waiting papers they must renew their visa or they are technically her illegally. If they get visa renewed no problem. They are trying to do the right thing so the right thing is to get visa renewed to they can still be legal.

Are you saying they pay for thier kids' school as in private school?
If so, I personally wouldn't have as much of an issue with them because our failing schools are the reason I am as upset as I am over the issue, and even if poor people pay taxes they aren't able to pay enough to cover their children's education.
They are still illegal if they overstayed their visa. It is just if even a large percentage of illegals were like them, I wouldn't have as much of a problem with it. It still isn't fair to those who are standing in line to come the right way, of course.
