UNUM is trying to get me to pay over $61,000 in alleged overpayment of benefits and yet my CPA sees that UNUM underpaid my benefits and wrongfully terminated benefits. I do not trust the justice system since UNUM has deep pockets. So, what can I expect at my settlement conference?

I think your best bet at this point is to file a complaint with your state's insurance commissioner's office. The commissioner has investigative staff, who will look into this issue and ascertain whether UNUM violated the law and additional benefits are due.

One note about overpayment: typically, disability income policies will have a provision that states if a person receives Social Security Income benefits due to disability, the insured must pay back the majority of benefits paid. This is a legal provision in this type of contract. So if UNUM is demanding this amount back from you, it may have a strong contractual basis behind it. Certainly, any underpayment it may have made can reduce this amount.

But again, I do recommend you file a written complaint with your insurance commissioner. It's a free process.

Do not worry. In my country at least, the courts are favorable towards the insured, rather than the insurance company. Of course you should confirm from your courts. By the way, insurance companies here are terrified of the harmful publicity generated by a defeat in the court. All the newspapers print such news with enthusiasm. If the insured loses in the court, the newspapers remain silent. Please note that I am not from USA
