The car insurance company paid the collection agency for Hospital bill April of this year yet they are still sending me letters. They claim to have not received a check when i sent them a fax with a letter that it was paid and the check #. Two weeks ago I sent them another fax with another letter from teh car insurance company and they claim to have nor received, yet I have a fax recweipt that says it went through. I even confirmed the #. These people are realy getting on my nerves is there anything I can do? Everyone i talk to tells me different things, my insurance advisor even called them on my behalf and spoke to the supervisor and got no where.

At this point, your car insurance company needs to go back through their financial records, and pull up the front and rear scanned images of the paid check for the services ... and provide that copy to you, the Hospital, and the Collection Agency .. (and make sure that you get from the Hospital their RECEIPT showing the BILL is PAID in FULL TOO to include in the letter to the collection agency) and this needs to be done by a Certified/Return Receipt Letter.


Then ... the next thing to do is to take another copy of the SAME Evidence and report the Collection Agency to the Better Business Bureau where they are located, as well as the State Licensing Boards that they received their business license from. BOTH of these complaints need to be FORMALLY in writing, and include a copy of the SIGNED Return Receipt showing that the Collection Agency received the PROOF of Payment.

After that point, if they do NOT stop their calls to yourself ... you need to start talking to the legal experts in this matter.

(This suspiciously sounds like a possibility of Fraud and/or poor recordkeeping ... don't know which ... but it can easily be remedied by the steps above ... if it is FRAUD (and even after you verify with the hospital that they received the payment .. and PROVIDE The evidence that the HOSPITAL Even shows the bill is paid), then you can file with the police an affidavit of complaint as well -- and it can then be investigated as such (and remember to attach the proof you have of the check as processed, the payment in full receipt of the hospital with the complaint))

Send them the same copies, but this time send it via US Post Office, certified mail, return receipt requested. Somebody has to sign that green card. When they keep harrassing you, file a lawsuit or wait until they file against you. Keep that card like you would tax returns. Keep a track of whoever is speaking with you. You also have to get a copy of the check from your bank showing the back side endorsed. That's your real proof. I think that department is trained to say, "I didn't get the fax".

You need to get the Attorney General for your state involved, since they are violating your rights. Write them a letter to this effect:

"According to the FCRA I dispute your claim and am charging you to stop contacting me about this debt. You are paid in full and are violating my rights by contacting me. Please note that I am sending a copy of this letter to the Attorney General's office."

Tell the Attorney General's office what you have told us and the AG will contact them to find out what is going on. At this point it's too much for you to handle alone.

Send a letter certified mail stating that his your good faith attempt to clear this up. Enclose copies of all documentation. Next step, contact the Credit Bureau and ask what you can do.. reprot it as a being wrong and they usually can help you.
