This is an extremely complex issue. It is so easy to judge when you are on the other side of the fence. It is always important to notify a sexual partner that you are HIV positive, even when practicing safe sex. The problem is that it is not so black and white when you are positive.
HIV positive people live in fear of rejection. You tend to take things slowly, trying to find the courage to take that next important step before sexual activity begins. Your mind begins to scan through all the possible outcomes, which makes the fear worse. For some individuals, I believe that a form of denial takes hold and they begin to believe that they have already said those dreaded words or they completely forget to by blocking it from their minds. This isn't always a conscious act. I believe that many of us have the intent to be truthful, but the mind takes control.
Being an outcast due to social stigmas is a very damaging thing. Sometimes people become numb. Most of you are young and cynical at this point. Give it a little time and a little experience with life and you will find the world is not so black and white. I am not excusing the failure to inform. I am simply trying to provide some insight. I pray that none of you every have to experience this first hand, but remember that compassion and understanding are important.
BTW - I am in a sero-discordant partnership, meaning I am HIV positive and my partner is HIV negative. It can be successful as long as you are open and honest.

If someone knows they have hiv/aids & they don't tell their sexual partner(s), did you know its against the law in most states. Just recently, a woman in my state was sentenced to prison. She didn't give a reason for not telling her partners. I would imagine if someone knows they have it they don't care.

If someone knows they have HIV and they have sex with someone without telling them then they can go to jail. It is against the law.

Because they are afraid they will lose that person and also the stigma that comes with a person who has the disease. People might treat them differently or avoid them, making them socially isolated. But they should alwyas tell, its just the right thing to do.
