OK before anybody just attacks me I've had a lot on the past few months including being very ill and I forgot to sort out my tax, in fact I only just remembered on Christmas when I got out of my car at my mums house and noticed my tax was way! out of date...any way my MOT has run out also....I know! I know!, but go easy I'm feeling like sh*t at the moment :(

Where do I stand legally? and what should I do? I'm trying to sort out an MOT and will backdate the tax when I get it(I'm know tax dodger) I was thinking of contacting the DVLA but I'm worried they will just slap me with a grand fine:(

Hi guys thanks for the answers I rang the DVLA this morning and they told me to write to my nearest DVLA office to offer to pay the late tax, she didn't know if I would get a fine or not, I was then put through to there automated SORN system that informed me that due to the discrepancy I would be hearing from the DVLA as I had broken the law(sounded quit ominous :( ) I've been honest with them and said I want to pay the back tax so if they try to screw me with the £1000 fine I wont be happy, £80 fine is fair enough but I think the grand would be a bit extreme.

You won't be able to register your car until you pay the tax...they won't come after you or anything but you won't be able to drive.

You are allowed to keep the car off the road (eg. in your Garage) w/o Road Tax (you have to fill out a 'SORN').

As soon as you use it on a public road you MUST have Road Tax & MOT - if you are stopped with no Tax you can be fined - but if you have no MOT, your Insurance is invalid & you can get arrested for driving w/o Insurance (fat chance - half the crooks in my area swan around w/o Tax & the Police are too busy persecuting motorists caught on the cameras doing 34 mph in a 30 area).

Get the MOT sorted first (you can't have it backdated).

Legally you should sort out the mot, then visit your nearest dvla office with the usual forms. I doubt if they will hassle you unless you didn't have insurance. Good job they or the police haven't contacted you then you would have got the fine.

Somestimes things just fall into place like that and when you have illnesses to deal with it is easy to get behind on financial matters, especially when do not have additional help.

All you can do in any of these circumstances is simply be honest with what happened and do what you have to do to clear them up.
