My neighbor trapped my cat's....I am heart broken. I have anxiety and they helped me cope with my problem. Without my cats I am very upset sad heart broken can't sleep at night and having anxiety problems....Can I sue my neighbor for emotional distress? I live in Califonia.

There is something called IIED (intentional infliction of emotional distress) so you might be able to depending on the whole of the situation. Call an attorney that does free consults and ask. It never hurts to try.

And I'm an animal lover. I would be devestated too.

Hopefully your cat was simply humanely trapped and can be retrieved. If so, I suggest you keep him/her indoors in the future because next time your horrible neighbor may seriously hurt or kill your pet. If your pet was killed, I truly empathize. I am very sorry... You may be able to get this horrible neighbor in trouble for animal cruelty (unfortunately not nearly as much as he probably deserves - perhaps a fine and a few days in jail). If the police don't want to do anything about it (which hopefully they will), go to the press. I live in CA too and luckily there is a fair amount of respect and sympathy for pet owners and pets relative to some parts of the country (still not enough, though). Unfortunately, our primative society still does not value pet or even the human pet bond very much. It won't be easy, but I have a feeling somebody in the press will at least be able to open a diaglogue. Even if it lasts briefly, it will make people think. Perhap more animal welfare laws will eventually be inacted.

Is it possible that your neighbors trapped your cats because they caused your neighbors distress in the first place, by messing up their lawn/plants, stealing food from their kitchen, etc? Be careful, they could counter-sue you eventually.

were you breaking laws with all those cats? you are lucky your neighbor didnt sue you, you cant allow cats out here on their own at all, mine are inside, and i put a trap on my porch and trap cats all the time who come up here to pee on my porch, i send them off to be neutered, but they do return them to the neighborhood. no you cant sue her unless what she did is illegal where you live and i doubt it was. If i called animal control these cats would be killed in hours of being picked up instead of neutered.

did he kill the cats? can you get them back? i'm so sorry how awful. but you should try to keep your cats inside for their own safety, they can be quite annoying to neighbors with pooing in their yards and getting into their trash, etc...still that's not excuse for your neighbor to just take your cats. you can call the police or animal control on them and hopefully get your cats back. and since you live in cali, oh i'm sure you can sue for just about anything, but will it help you or your cats any?

Did your neighbor do this intentionally? There is something out there called animal abuse. I would have called the cops.
Call a lawyer. They will tell you what you can do.
