Need advise where to start. Never married to childs father. Who do I talk to about seeking assistance for legal representation in a custody fight. Ex's relatives will pay as much as it takes to get him custody and his relative is very influential in the community. Infact most people fear her. Sky's the limit for money.
I'm on disability and have no money for legal representation. My son's father and I have been sharing custody 50/50, no problems. Till he got mad at me and his aunt(she pays all his bills and he doesn't work)has pressed the issue. She's done this before and I reasoned with my ex not to go through w/ it. This time I don't think reasoning with him will work. I'm not even able to scratch the surface as to what they have up their sleeve. But I need to know where to start looking for help. I'm in the State of Nevada, in Elko County. One more thing, Most everyone in the town I live in, do not dare to cross this rich aunt. Not even the authorities in the town. PLEASE HELP ME!

I checke the web page that is just like this but theres lawyers answering questions by states and issues. i think is lawguru.com something 'guru' search for it im sure you will find it , they really help for free in there

Prepaid legal is a generic service to help with simple actions ie drawing a will, perhaps writing a letter.. lawyer referral. It is not what people think. You need a serious lawyer and yes, that is going to cost. This is hard for me to answer, without emotion. You say you 'sent' her to live with them, but don't mention if there was any legal paperwork behind it.. ie power of attorney, temporary relinquishment, so forth. I am not able to answer for your state.. Texas 3rd party custody is based in (1) the fact of disrupted family (divorce, jail, etc) and (2) the parent must be shown unfit. Things change when a parent gives custody without being forced to. In other words.. if parent gives up their rights on temp basis, THEN the parent not only has to show they are NOW capable to take care of the child, but ALSO the parent has to prove the child is at risk, by staying where he/she is. The rulings that I have seen (and by my own research) is that courts tend to say that the child has now bonded, and it harms the child to be 'unstabilized'. The length of time works against the parent. Of course, what I read, does not go into parents being tricked, threatened, etc into "voluntary" giving custody.. as my daughter/husband were. I am not a lawyer. IF they filed, one 'answer' I would think of, is that they may not meet the grounds for 3rd party, if they cannot show you are unfit. That might not be enough, since you left her by your choice. The alternate is to prove that remaining with them, is harmful to your relationship, thus a harm to her. YOU NEED A GOOD LAWYER. And since they have filed, you have to fight now.. the longer it drags out, the harder it is. If husband is the father, that helps.. unless they hate him so bad that they will try to show him as unfit. My only advice is to not not not give up. My daughter gave up, or was threatened into giving up, and she has lost, even though she is too stupid to know it.

It sounds like you are in a difficult position. Don't give up though. An attourney will be apointed for you if you can't afford your own and the key is making your point to the jury. Just remember that it's not money that wins a jury. Show them that you are a good mother and care for your children and that you think your kids should have both of their parents. If you can win over the hearts of your jury you can win the custody battle.

I work with people who have disabilities, and have them myself as well. You could appeal to the kidness of a legal firm, some do pro-bono, free work. If any of it has to do with your disability, you can ask Disability law center for help, The link for them below may be able to provide some resources for you, or a disability advocacy group, many have resources, but not living in your state, I don't know the ones that fight for people in your area. If you contact Disability advocates, there are many groups in every state, they should be able to tell you more.

Try calling the Department of human services in your area and ask them if they know of any legal place that can help you. Thats how I got the legal help I needed. I dont know if your state has one but it doesnt hurt to ask. Just explain whats going on. You shouldnt have to give them your name.

Look for someone who needs or wants a pro bono case like yours.
