It is recommended speed but if you are deemed to be driving unsafe no matter what speed or speed limit you can be ticketed.

As others atted before me, the yellow signs are recommendations. I once asked a state police officer (I saw him in a store) about the ticket issue, and he said they can't ticket on a recommendation. However, if you are involved in an accident in that area, and were exceeding the recommended limit, you are given a ticket for "Unsafe Driving for Conditions" or whatever it is called in your state. That said, I then decided to ask my boyfriend, who coincidentally enough was a DA if the ticket would be upheld. :) He said the DA would most likely remove the ticket from your record as long as you did not have a 2nd such ticket in the next 2 years, so no points, no fine, just court costs, as long as you went clean.

Black & white signs are legal signs, including speed limits. You can get a ticket for exceeding those limits.
Yellow and black signs are advisory limits. You might get ticketed if you are driving carelessly or if the conditions are poor or hazardous when you exceed the advised speed.

Whatever is listed on the sign is the speed in which you are legally allowed to go. Only that speed. Not faster. Because of safety reasons, that is the recommendation.

You can get a ticket for driving 40 in a 45 mph zone, it all depends on the circumstances.

no you can't - since its only a recommendation.
but i've also heard, that if you have an accident, and it's determend that you were over the recommended speed, you'r car insurance my reduce your coverage. but don't quote me on that.
to the sign, it may not just be there because it's a tight curve, but also the road condition or road angle might be dangerous (pottholes i.e.)

my rule of thumb is that its normally safe to double the number on those yellow speed limit signs.
