I want to know if it is best to get a lawyer when filing for child support in Texas. I am the custdiol parent of my son and the father did not sign the acknwoldgment pf paternity. His Father now has got married and she is now pregnant too. I have been letting him see our son almost when ever he wants, but now he is getting ugly with and threatning a custody battle. I have had an intresting past but I do have a good job and support myself and my son. His Father is very vile persona and likes to fight dirty. I just want to know the best way to protect myself.

His father broke up with me when I was 5 months pregnant. He married a girl 11 years younger then him when our son was 4 months old.

You may not have grounds to file for custody. Some states don't require a man to support the children if he has signed away parental rights. I do suggest you seek legal counsel but it may not be what you want to hear.

Good job etc. is a plus!! Let him blow HOT AIR!!! GET A LAWYER ASAP!!!!! He fights dirty huh? Get ALL the back up that u can including social services, DNA test court ordered, child support started, keep track of everything he says and does GOOD and BAD! How much $$ he gives you and his son etc. Sounds like his new wife is starting something she better stay out of!!! Like a little devil sitting on his shoulder.Watch out if ya move to another state though: My husband and I both had exes that lived in Texas and the child supp agency head lady said that It is hard for Michigan and Wisconsin people(us) cuz Texas doesn't comply to good, and she was from TX!!! I could go on and on........

Call the Attorney General's office in your Texas city. Texas is really serious about non-custodial parents paying child support and they will go after him.

Also apply for Food Stamps and TANF (Temporary Assistance to Needy Families---AKA---The old Welfare Program.) If you apply for help, the first thing that both agencies will want to know is who is the father. TANF and food stamps will both go after him for you if you apply for their services.

I don't think that you need to hire an attorney until you try both of these things while going through the Attorney General's child support office as well. Keep a daily diary. Document dates of appointments, times, names of the employees that you spoke to and any witnesses. Also document every penny that the father gives to you for his son's support. Document dates and times of every single thing, both good and bad, that he does for his son. Document his visitation and whether he was on time or not for pick ups and drop offs.

Texas will find that guy, make him get a paternity test, and then either make him pay child support by cooperating with them or else forcing him to sleep at jail at night and work during the daytime. It's his child and he has to support him.

If you pursue it right now and document your case, and then this guy ends up in jail for non-support of his child. His chances of winning a custody battle will not be very good.

i think that you should get a lawyer. i think its always best to have someone who knows the law on your side . that way your *** is always covered and that way you are protected. you shouldnt fight this battle on your own and later say well i should have gotten a lawyer. good luck and stay strong for your son.
