Well, this is why I carry a disposable camera in my car. This way it keeps most people honest. I try to take pics all around my and the other person's auto, and try to "accidentally" get the other person in a pic or two. I take the license plates, make notes of the time of day, location, weather, other witnesses, if the other person walks around and looks ok - and of course get his/her name and insurance carrier.

But that is all water under the bridge for you. That's good info for the future.

As for now, leave it in the hands of your insurance company. Fill out what reports they have, and ask them for names & numbers of reputable shops for the repair to you car.

Get a camera, dude!

Don't sue the restaurant. Go into the office of your insurance agent, sit down and ask all of these questions. Different states have different laws about insurance. At the very least, if your insurance isn't enough, it would be a good time to up your coverage.

In Texas you best get a quotation should you broke probably the most site visitors legislation. It consistently says at the quotation what site visitors regulation you broke. The officer might have defined the intent for the quotation in your husband while he wrote it. Take the quotation right down to the police station and ask a person to give an explanation for it to you.

Kim Y gave you the best advice here. You will be laughed out of court if you sue the restaurant (how the hell is this their fault??). Sorry to say this but you may as well kiss this one off to a hard life-lesson.
