1. He can't pay taxes if he is illegal.
2. If he is so concerned then why doesn't he call immigration and find out what is taking so long
3. Why is he waiting so long since his friends heard responses months ago?

Are you in UK? If he had applied before his visa ran out, then his status remain as the same as what his visa stated, so he is technically not an illegal immigrant. Hence it makes a perfect sense that he is paying tax, and I imagine that is what's happening. So he can stay in UK legally mean while.
But I have to agree that they are taking way too long. I am not sure what kind of visa he applied for, but in any case it seems to me 1 and half year is too long. I understand that the immigration office is not the nicest people to talk to, and he has already tried, but all I can suggest you now is contact them again, tell them that it's causing so much inconvenience, and you have a baby together now, and want to marry. You should send then email or letter, rather than calling them, if phone call doesn't work. You might be able to complain to someone in higher position, so check UK visa and Home Office's site. Also, contact Immigration Advisory Service. They might be able to help you. Good luck to you.

If he is an illegal immigrant he can't be paying tax. I think you are telling little white lies. He is breaking the law and should not be here if his visa has run out. Ignore these racists jerks.Firstly, and in view of the time scales involved, there is every chance that they have lost the application,and no, they will never admit to it.
My wife is from overseas, and the best way to push things on is to request permission to marry,which you will need from the Home Office.
This will unearth the application, or at least make them adnmit it's loss, and when they do, you may well have an opportunity to use that to twist the arm required to speed things up.

if your partner arrived here on a work visa i assume he wasnt here to seek refuge from his place of origin(his country) when his visa expired he should of returned to his country and re-applied for a visa Dont you think it was iresponsable to start a family with an illegal immigrant? maybe im being synical but i cant beleive that the immigration autorities are not interested in pursuing the case of an illegal immigrant after 18 months!

(If in the UK), providing your parner submitted a completed application form before his 4 year visa ran out, he is not currently here illegally. It may be appropriate to seek some legal advice- perhaps check out the Immigration Advisory Service first (http://www.iasuk.org/) to see if the matter can be chased up. If he regularly signs on with a local enforcement office, he could also try to get them to look into it.

That was foolish, should've gotten married when he still had his visa. If you don't want him to get deported you should get married now and at the very least he'll get some consideration for overstaying his visa because he's married to a US citizen.

u need 2 contact a lawyer that deals with immigration. don't go through the legal aid cuz they take 4ever. hire ur own lawyer. people r going 2 talk no matter what. ignore them. they r ignorant. u will run n2 problems with some idiots name calling ur baby also. thats something u'll have 2 get used 2. believe me, i've been there. i married 2 different mexicans. the 1st one was already married n mexico & had kids & everyone thought he married me 4 his papers. WRONG!!!! he already had his papers he was just ignorant. he said he loved me & wanted 2 b married 2 me here & b with her when he goes home 4 the one month vacation time. that marriage lasted only a month. lol then i married another one who was a lot different. we r still married but have been seperated 4 abt. 3 yrs. we were married n 1997. things were great the 1st 3 yrs. then he started puttting his friends & his drinking b4 me. so i left & came back home which is up north. we used 2 keep n touch up til abt. 6 months ago when i moved n with an american guy. time 2 let it go. anyway, yes, i helped him get his papers abt. 2 yrs b4 i left. he really didn't want 2 go through with it but i thought it best so he wouldn't have 2 worry abt. immigration all the time. we started out with the legal aid & just wasted our money there & then decided 2 go through an attorney we hired. it costs a lot but ur better off n the long run. its best if u get one who has someone there n the office who can speak his language. good luck

You should first get married, and then you can apply for his greencard. Under current rules, being married to a citizen makes you cap exempt as long as there aren't other bars on you such as certain criminal convictions.

What is he waiting for from "INS"? If his visa expired his only option, other than being here illegally...is to return to his country and resolve his issue over there.
