I'm British and had a massive argument with my American ex-Girlfriend over our Joint Bank account. It ended up going to civil court while I was out of the country and I think i now have a civil court harrasment restraining order.

I would like to visit Las vegas with my new Girlfriend now but
does this mean I know have a criminal record? if i fly into the USA will i be deported or arrested? Is it even possible to be charged with a crime in the USA if you are not in the country??

Restraining orders are quasi-civil in most states. In other words, you are not a criminal as such but it is declarable as the restraining order predicates violence. If it is that, you will most likely be barred.

I hope the restraining order you refer to is to restrain you from handling the joint account. If that is the case, I doubt you have a problem.

It was a civil matter according to what you state in your questions. If it were a criminal matter, then yes, you would have a criminal record. Since it was a civil matter it doesn't give you a criminal record. As a matter of fact, I don't think that anyone other than those involved in the case probably even know that it existed. I think that you are quite safe to visit Las Vegas. Remember to send pictures!

Restraining orders do not constitute criminal records, because they are a preventive measure, and not a criminal punishment.

If there is in fact a restraining order against you (if there is one, you should be notified about it), you need to find out what is written on the restraining order, most likely it prohibits you from comming a number of yards close to your ex, so I don't think they would ban you from entering the country.

You're safe! It's not a felony or felony criminal conviction. Go to Vegas and enjoy the slots.

Although I think you'll be clear at the airport- I'd invest in a US lawyer before you come in and have him check out if you're ok to come in.

You may have to pay for it, but at least it'll possibly save your vacation. go cheap on the hotel instead.

NO, i don't think that you would be banned from the USA.
If you are in doubt, go to the American Embassy and inquire about your status.
