the prob is i want to give my child my families last name because my husband is not the father and the babies father doesnt want nothing to do with it so i dont want to give it his last name can i legally give the child whomevers last name i please?

Legally you could give him any of the 3 last names. It's your preference. Since you're seperated from your husband and he's not even the father, I think it's the right thing to do to give the baby your last name, unless of course you're planning on getting back together with your husband.

You can legally give him the real fathers last name. It doesnt matter what he want or you can have you husband adopt the baby and have his last name

Depends what state you live in. In Virginia, they automatically give them the mothers last name. No matter what the situation and no matter what you request.
