I've applied for a J1 visa waiver, and I'm now waiting for a response. I read it takes up to 5 months. I also have a turist visa, valid until 2010. I'm not currently working...I quit my job. The question is, can I travel abroad and come back with my turist visa? and can I expect to get my waiver approved even if I'm not working? I'm being suported by my fiancee. I hope to get answers to this...I've done a lot of research online, and nothing! Thanks

I presume you applied for a wavier of the two-year home residency rule that applied to your J1 visa because you were government sponsored. You can use your B1/B2 visa while you're waiting for the waiver and the immigrant visa, but be careful not to overstay, and be prepared to answer questions honestly when you arrive in the US.

Unless your waiver request is for an employment-based immigrant visa, it makes no difference if you are working or not.

PS - the previous answer was wrong. Consular officers always give full-validity tourist visas (often up to 10 years, depending on reciprocity between the US and the other country) unless there is a specific reason to limit them.

Normally tourist visas are not for such long periods, you probably got your visa because of your work. As a result, there is a chance that you could have problems when you returned, but you would probably be okay.

As far as visa waivers, it all depends what kind of waiver you are doing; most require an employer sponsor.
