i dont want to live with my mother any more, i am 16 years old, i do not want to wait till 18 i cant! i have spoken with her and she will not sign any papers or let me live with my stepfather, is there any way i could bring this to a family court or can my stepfather and what are the chances i will get to live with him?

petition the court to be emancipated as an adult but be prepared to prove to the court you can provide for yourself or prove that there is a hardship living there

I'm not sure about your state, but you should be legally able to decide by the time your 16. However, him being a stepfather and not a biological father may change things. I know in Ga., you're legally allowed to leave home with anyone and your parents can't do anything about it. Think about what you're doing before acting on it. I don't know what kind of mother she's been, but that would be the ultimate hurt for me from my child.

It usually depends on whether your bio father is involved or not. If he is it will be harder to get approval. You need to make sure that your step-father will be alright with you living with him. You are of an age where you can decide who you live with legally through emancipation or through speaking to a judge or your step-father's lawyer about the circumstances at home and why you would like to live with your step-father. The best way would be to have your stepfather contest custody, esp. if your dad isn't in the picture and your sf has been your father figure primarily no matter the length of time you've known him.

ok im confused cuz if he is ur stepfather then he is ur moms new husband and therefore livin w/ him would b like livin w/ ur mom rite? or maybe he is ur moms old husband and they r now divorced but u still consider him ur stepfather? if thats the case then im pretty sure the only way ur "stepfather" can get custody is if ur mom abuses u or is unfit 2 raise a child. im not implying that ur mom does that im just sayin i think thats the only way he could get custody.

It wouldn't be right for you to live with your stepfather, remember he is just your stepfather and sometimes stepfathers will be a little to free with their feelings. I have heard of stepfathers that take advantage of young girls by touching and then sex.

I can understand not living with your mom. I am old and I can not go anywhere near my mom. She becomes malicious when we are together and I fail to stop the action even as an adult. She is very harmless as long as she does not have a follower and a cohort. No one can imagine except those who have attempted to be with her. She is well cared for but from a distance. Try that adult thing. good luck.

You do not say that your step-dad wants you !
So dream on.
You can't make it with your mom? Why would it be any better with Him? You probably stepped all over his toes as well.
As I said You Know what to do.
You settle down and accept what your mom has Or
You settle down else where Or screw up and waste any chance.
For Us we really can only wait >!< We really don't care.
We will applaude if you rise above and just shake our heads otherwise

well here is what i have been told since my parents got divorced when i was 4. if my mom got re-married which she did then my stepdad gets half of her custody if they ever got divorced. also you can decide where you want to live when you are 14 in most places. so talk to your step dad and explaine it all to him. maybe he will be willing to help you take the proper actions you need to take. your step father cannot have custody of you r because he is not your biological father. You're just gonna have to wait until you're 18 but by that time- you will not want to live with any of your parents anyway so you can party.
