Depends, did he know he had it. I heard that the quarter back for the Atlanta falcons was sued by some girl, because he gave her herpes. He knew he had it, cause he went to clinic with the alias Ron Mexico. I don't know whether she won or not but she probably got a settlement. Unless you can afford it, trying to sue someone just ends up costing you more money, then what you are actually getting. Talk to a lawyer about what would be your best choice.

I'm so sorry, hon! It's terrible that we have so many dishonest people in this world, especially when it comes to serious stuff like HIV.
I don't know about suing, to be honest with you, but I DO know that it's a crime to not disclose your HIV status to your partner if you're positive.
Before you proceed, are you sure he knew that he had it when he slept with you? If not, then no one's really guilty. If so, though, the first person you need to talk to is an attorney. Have your attorney familiarize you with the federal laws and the laws of your state. Some attorneys will take cases like yours, and others won't.
That's your first step. Second step, you need to see an infectious disease doctor so that he or she can measure your CD4 count and your viral load to determine if you need medication.
I'm going to send you to a link that may help you. It's a forum for HIV positive people, and not only can you talk about what you can do by the way of the law, but you can talk about day-to-day like with HIV.
Good luck to you, honey. I wish you the best.

I'd be more embarrassed to have HIV than ask for a health record before f*cking someone.
You can sue anyone you want, for any reason, whether or not they have the money is a different issue.

Yes! The following link is a state by state break down of the laws in cases like yours. In California, it's a felony to not disclose your HIV Status before engaging in unprotected sex.

It depends upon once they found out they have been positive. Don't tell the person you must sue but. See if which you can gather more evidence that suggest malicious intent or that they knowledgeably passed it on. Consult a legal professional instantly before contacting the individual anymore.

Sue? I'm quite sure of it. And unless I miss my guess, you can have him arrested. It's a felony, in most places.
Make absolutely sure that you get good health care, first of all. You can manage HIV for many years, if you have good medical care.

You can sue anyone who causes you to be injured through their negligence. However, all homeowners insurance policies exclude coverages for damages resulting from communicable disease transmission.
In other words, you might win the suit against the guy, but his insurance ain't gonna pay.

yes if he new he had it and didnt tell you you can sue him and get him in alot of trouble. he can go to jail for this. do you know for sure he knows he had it before you had sex with him? do you know how long he has nown? he could be going around giving to every girl he can, because he is being a creep and is his way of making him self feel better. i would see a lawyer asap and have him stopped. i am sorry to here about this. if you know any of his exs and they are infected you could probly get them to go to court with you and that would strengthen your case and give him more jail time.

You most certainly can!! And should!!! But.......first of all look after your health. Do everything you possibly can with your doctor as a priority to seeing your lawyer. Take care.
