In Georgia you have 48 hours to get a warrant. If the facts you have posted are true and no important facts have been omitted then you should be talking to a lawyer.

Unfortunately, it somehow seems to be true that you can be kept "detained." If you are not pronounced under arrest, you ae not entitled to the same rights as someone actually in custody.

To me, this is a stretch of the word "detained." If you are deprived of your freedom and especially in the process you are being treated abusively, then if this is technically legal, I think it's something we should start questioning and start contacting Internal Affairs about.

Internal Affairs is not just a bunch of other good old boys. They are not entwined with the police. Obviously, the first response is to think, 'Sure, everyone has a gripe,' but when enough people have similar complaints, ala Signal Hill and recently Sacramento P.D., I'm sure the ears start to perk up. If you were put in general population you were arrested. If the police did not question you then they don't have to read you your rights.

I was arrested in Oklahoma and they didn't read me my rights. My attorney said, they didn't have to anymore, because of the Patriot Act. So, if this is true, you just go ahead an email Mr. Bush and see if you get an answer.

Yes, it is legal. If there is enough evidence to arrest they don't need to talk to you at all. Miranda Rights only need to be read to a suspect before an interrogation.

It don't matter if it is legal or not I have been saying for the past 3 days the police are out of control in this country. If you commit a crime you are going down. But if the same crime is committed by a cop or one of his friends it is a good chance they will turn the other way. I know of a 15 yr old boy who got a ticket for not having a bell on his bike. The judge went nuts when she saw this kid in court. She called his captain and ripped him

The way I understand it if your not under arrest then they can't keep you there more than 24 hrs. but I'm not sure on that.

i don't know the story so i won't speculate but don't be confused about your rights being read to you. They are not required to read you your rights unless they're going to question you about the crime or other crimes you may know about.
