State labor board. Laws and regulations vary from state-to-state. For example, I once crawled to the phone to call in sick because I had messed up my back real bad. My boss, being a kind-hearted soul, told me that if he insisted I would have to come to work or lose my job. He didn't insist, but was threatening me. I checked with my state laws.... and he could legally fire me. What a jerk!

Unfortunately, the laws do tend to protect the business owners more than employees, unless you are unionized.

Goes state by state but, in my understanding, no. Labor Board and regs require breaks for employees, not break rooms.

One other response was correct that you're whinning. The world doesn't owe you Hilton style accommdations. If it's such a big issue, why not gather the other employees and make it an employee project to make the place nice?

an addequate break room?..are you serious?..how about you try working a real job, like construction where you piss is a steaming hot porta potty while the smell of baking urine and feces overwhelms you....you find somewhere thats halfway clean to sit on the job site to eat your sandwich with your dirty hands....stare at the stuffy white collar stiffs that dont know which end of a hammer to use, and it just so happens the building your putting up is for them.........you slam a cup of coffee,get a good burp in,scratch your nuts....and get your *** back to work!!!...quit your whineing and be happy your working!...oh by the way..try the peanut butter ho-ho's in the vending machine...there fabulous
