Unfortunately if the court orders it you have no choice, but please have no worries if this guy is as big a loser you say he is then you wont have to worry about him staying in the picture. Make sure when you go to court that you have as much proof of his bad behavior as possible that way you can fight for no visitation or suporvised visitation and then the idiot will have to at least pay for his baby even though you dont want his money you might as well take what you can from him if he want to protect his reputation so bad then he can pay for it.

YOU won't be the one to give him a paternity test. If he wants to take one you will be ordered to all them to do one on the baby. Whether you WANT him to have that right or not is not up to you it is the LAW. Either you comply with the law or you will be held in contempt and could forced to pay a hefty fine as well as serve time in jail. So which would you rather do? Comply with a court order and be able to stay out of jail or be in contempt of court, pay a fine that you probably can't afford right now anyway and go to jail for a couple of days, and not being with your child?

If you're not married and he doesn't sign the birth certificate, he has no legal claim to the child. Just make sure you don't go around telling people he's the father. Tell everyone someone else is, or at least that he's not. Make up a name. Say it was a one-night stand. Anything but admitting it might be him. That way he can't claim it's "common knowledge" that he fathered the child.
He can't take you to court. The judge will throw out his case.
Don't worry, honey. You might have to get a lawyer just for the legal things about challenging his case, but you'll never be ordered to have anything to do with him.

If he takes it to court more than likely they will force one. I would advise you to find a lawyer who specializes in family law. If you live in northeast Ohio contact me and I can give you some names.
If he is mentally unstable and abusive you should start documenting it. It's even better if you've been doing it all along. Like photos or doc visits after the incidents. And, having people stand by you who can attest to his mental capacity is helpful.

depending on the state. With me my sons dad was on the birth certificate. We were never married. The court did not make him take a paternity test because he was on the certificate. Now if either of you are disputing that he is the father then the court will probably make him take a test. I would contact an attorney to make for sure. My sons dad had another child ( never married to her either) and she did not put him on the certificate and she filled for child support and they made him take one. It depends on your situation and whats all involved

I am unaware of your current or past situation with this man but I would give him the paternity test just to get him out of your life. If he isn't wanting custody of the child in question - just do it girl. Let yourself move on from this man. Protecting his reputation huh?....nothing like having his priorities in order...Good Luck with it all.

You do not have to do anything. If his name is not on the birth certificate, then he can not prove the child is his, unless he has a paternity test done. If he is seeking the test, u can give it to him and then if he dont want anything to do with the child, have him sign his rights away.

I would try telling him that there is no way the baby is his. If that doesn't work then get a lawyer to keep him away. You can get supervised visitation if you can prove the baby will be unsafe with him. I am sooo sorry you are going through this and I wish you luck. I will be praying for you and this baby.
BTW.... I am glad to see a good mom on here that only wants what is best for her baby. Congrats.

Yeah you have to give him the dna test...even if you dont want too..you can avoid by not going when they tell you too but the next time your court date rolls around theyll court order you and if you dont do it then theyll put you in jail. It'd proably be better just to get it done...try getting a really good lawyer serving him papers and trying to get him to sign his rights completely over and then you really wont have to deal with it..either way goodluck

If you don't want any money or anything then you shouldn't.
If he wants parental rights or custody he may force one.
If you put him on the birth certificate he may not even have to have one unless you refuse him rights,.. then he can demand one,.. or the Judge may.
