No, you cannot be charged for being in a photograph with marijuana.

However, law enforcement may be able to identify you as someone who is known to possess marijuana and may use that information at a later time.

I would definitely get rid of that photograph since you wouldn't want an employer, teacher, parent, etc., to find it and think poorly of you. Those things tend to pop up out of nowhere when you least want them to. Did you ever wonder how the tabloids and paparazzi find these pictures?

Photograph with a marijuana is no a crime because it is not one of the instances in the Penal Laws which is defined as a crime in relation to marijuana. Only possession and use of marijuana are punishable under the law. Picture with a marijuana could only be considered evidence if it was taken by someone while you are using or selling marijuana. However, if it was used for display or for fun only, it is a different story.

depending on pic.. Smoke coming from your mouth is use only if it can be proven .
unlited substance in hand could be anything.
Plant growing in ground could be anyones or wild .

No, because it doesnt prove that you are in possession of the drug. If the police see that photo, it may give them probable cause for a search warrant, and if there is any marijuana in your house, then you are screwed.

No, you can't be charged. But if it was a large quantity, it could be enough to make the police check out who you are and what you do.
Get wise to yourself. Don't ever pose with ANY illegal substances. Keep your business to yourself and try to fly under the radar. Good luck.....

No. The police have got to find the substance on you. The pictures can be used as corraborative evidence if you are ever arrested for possession though.

its been done before, cops do stings using cameras dressed up as hippy stoners, they get a lot of funny shots, and post in on the internet, offering 50 bucks for people to identify the people

My daughter-in-law was arrested for having a laminated leaf in her wallet that her father give her, so who knows, these days...And it's very easy to get paranoid these days...
