It can be charged either way, but it is usually charged as a Felony! You can file with the judge at the time of sentencing a motion to expunge with a condition that all penalties are successfully completed!

I think some states use that one if you have over a certain amount. Think its a felony. Im pretty sure you can be charged with it if you have a larger quantity than just personal use or if you get caught trying to sell drugs.
