No, it isn't illegal for an officer to mace a pregnant woman. The question should be what was the woman doing that caused the police to mace her? The only thing that mace/OC spray does is inflame the mucous membranes. That is why the nose starts running and the eyes start burning. It does, sometimes, cause a mild irritation to the skin. But it is considered a non-lethal use of force. As stated in the other postings, use of force is authorized in order to protect others and law enforcement. In all actuality, whatever this woman was doing this was probably the least harmful way to get her to comply, better than getting hit with an asp or taser.

it is not illegal for an officer of the law to act to ensure the safety of himself, the suspect, and any bystanders. Macing a pregnant woman for no reason is illegal, but macing anyone for no reason is illegal. if the cop feels there is reasonable justification for deploying non-lethal countermeasures, then the physical state of the suspect is irrelevant. the cop would have to justify himself to his superiors, and there might be more scrutiny in such a case.

No... If she was doing something that any other person would have gotten maced for (being disorderly, fighting with the police, etc.) then it is completely legal.
Just because she was pregnant,it does not give her a green light to get away with anything.

Mace or pepper spray will not harm an unborn baby. It is a lot better to use pepper spray to try to subdue a person than physically wrestling with them (especially if they are pregnant).

a physical altercation would cause a pregnant woman more harm than being maced. if she was being disorderly and not cooperating with the officer and if she threatend the officer. then yes it is legal for the officer to spray her.

no, if you endanger a police officer's life he has the right to either shoot you, mace, tazer, or take an asp to you. A decent minded cop, like me, would take extra precautions to protect you and the unborn child. but it is in your best intrest to stay safe and stay within the law, so you dont risk it.
