Is there a complaints policy or do I have to threaten court action?

It's nothing to do with microsoft, any action you take is against the shop where you purchased it.

Depending on it's age it may have to be sent for testing before you get it exchanged/repaired.

In the UK if it is under 6 months old it is deemed to be inherently faulty and you can demand a replacement, over 6 months you have to prove the fault existed, if you can't then repair is the only option unless the supplier cannot repair

I have heard if you trade in broken XBOX360's that you can buy a Wii for 250 or a PS3 for 600, I would look into one of those deals, they sound pretty sweet.

if its under a year old take it back to the shop you brought it from with its receipt and they should do something to help you.
