If someone has custody of your kids then you still have parental rights which means you can regain custody.
If someone has parental rights, then you don't have parental rights and cannot regain custody.

Basically, a technicality. When someone has physical custody of your children, that means that the child lives with them, but you still retain some rights as the parent. If the person has legal custody, however, then they are able to make decisions for that child as if they were the parent. When someone adopts a child, they are the new parent and guardian of the child. That means they have physical and legal custody, and the people who are not the adoptive parents have no parental rights any longer. You may want to talk to a lawyer for your specific information.

Temporary custody is granted by the courts. The adoption process takes months, the birth parent has to meet any number of provisions imposed by DHS and the courts, numerous home visits of the potential adoptive home, family studies conducted, case management review and recommendations which are then presented to the courts - at which time a judge can terminate parental rights and the adoption of the kiddo(s) is granted. This can take a year or longer in certain cases, all dependent on the case itself. If you are facing this situation, I suggest talking to the case manager and asking lots of questions - make sure you understand what the timeline is and what the court is mandating the birth parent to do to meet compliance (clean UA's, job, housing, counseling, etc)

although they are both granted through the court system adoption means that they are yours forever and custody means that it can change any time the other parent wants to do something about it. trust me. my hubby has custody of two of his kids and i cannot adopt either one because the moms are always dragging us to court or have a story or to to tell when ever the thought comes up. i have had custody of the older boy for nine years and mom has not seen him in 8 and i have had custody of the girl for 6 years. still we take them to court and they always get thier way. they would be better of making it permanent with me with adoption but nope. court systems can be screwy.

Custody- generally temporary, overseeing the well-being of the child.
Adoption- permanent, all legal decisions go to the adoptive parents.
