hi a friend of mine was recently arrested for 'common assault' on a train ticket inspector. But he didnt beat him up or anything, it was a 50/50 nudge. anyways he was arrested but wasn't charged so released on bail. hes gotta go back next month. He's scared he might go to prison for it as he has a previous for affray 5 years ago and he did some community service. I told him he wont have to go to prison but what likely is he going to get for it?

yeah hes been soiling his pants but hes got to answer bail next month so still doesn't know whats going to happen to him.

A previous case will only be used as an aggravating circumstance if the present case was proven. In the case of your friend, he was released without being charged. Thus, the previous case has no bearing on the present case. Nevertheless, your friend must be careful in committing another offense to avoid trouble.
