I am currently living with her and I would like tostay in the home.

If the property belongs to her, and she can't afford to pay for the nursing home expenses, then the government will take the house to cover expenses. If she has signed the property over to you (or someone else) prior to seven years before she goes into the nursing home, then it would be clear of risk.

You need to go to a lawyer and have her to sign the house over to you, and any assets, If you just have power of attorney, then the nursing home will still want to be paid. But if it ends up that your mother has nothing, then all the nursing home will do, is take her social security check. But if she has property, them she will have to pay.

She needs to award power of attorney to someone, if it is not already stated in her will. This person would be given power of all her assets and power in decision making for her in the future.
