my partner is a mental patient and i slapped his leg and bum cos he was getting out of control as his become addicted to drugs, last year he had me in court and now im on 12months good behaviour now his saying he can put me in prision for trying to bring his violent temper down against me and my young son, can i go to prision for this.

By partner do you mean common law spouse?
You shouldn't be hitting anybody who is an adult for behaviour reasons, this is spousal assault no matter what the reason, you should be getting a new partner.
You can defend your young son if this person is violent toward him but this opens you up to all sorts of problems. Get out now.
