I have a friend who has been living with me in my apartment since October 3, 2006. He has not been paying any rent to me. Our friendship is not working out and i want him to leave my apt. He is refusing. Do i have to get a warrant to evict him, or can i simply call police and have him removed?

File a case against your friend so that the court will issue an order for his eviction.

If your friend has not contributed to the upkeep of the household (paying rent, helping with bills, buying food, etc) AND he's not receiving mail there then you should have a pretty good chance of getting him out with just the police/sheriff's office. However, if he has established "residency" in your apartment, then you will have to contact the Sheriff's Office (warrant & civil unit) or the Magistrate court so you can get a "writ of disposessory" (also called an eviction notice). Your friend may be able to contest the eviction and drag it out in court...but chances are he doesn't know that or have the money to do so.

Best case is you have him out in a few hours, worst case is a few weeks.

If your name is the only one on the lease, contact your local Sheriff's office and they can tell you the proper steps to take to have the person evicted. I'm sure you'll have to serve the person with some sort of formal notice.
