Besides going for political asylum..what options are there? I was informed that one might be able to post a bail or bond? When I ask can they get out..I mean out of jail and remain in the US.

El Salvadoreans are covered under an old court case from the 1980s that the Department of Homeland Security wants congress to correct so that Salvadoreans can be deported as easily as Mexicans.

It is first up to the Supervisor of the organization that apprehended him. The Supervisor can release him on bond (the supervisor sets the amount), or on personal recognize (his word). However, DHS has been saying that there will be no "catch and release" at the border any longer (Since October 2006) however they do "catch and release" in the interior based primarily on available bed space in the detention facilities.

Salvadoreans that have been here years are granted Temporarily Protected Status (TPS) which has been renewed every year since I think 1993. They remain here until a president does not renew the TPS.

A newbie is basically out of luck if he was caught near the border.'

I do not believe any Salvadoreans are being granted political asylum, since they would have to prove a creditable fear of political presecution if sent back home.

If they let that Salvadorean in after coming here illegally, then millions of Salvadoreans would be here tomorrow.

He may not be given the option of posting bail as he could be seen as a flight risk. In my experience as a social justice worker in Texas, he will probably be deported without bail being offered. Sorry

I heard about that on a news program. They are listed as OTH (other than hispanic). They are given a letter with a date of when to appear in court and set free whereas the hispanics are taken back across the border. Since these people are not from Mexico, they cant simply take them back across the border. The biggest majority of them never return for the court date. They disappear into society.

I wish they could be arrested, go to court the same day, then deported. Nice and short.

The way I understand it, if they post bail they are free to go....But are suppose to return to the court hearing.....But of course, many never go back for the court hearing....
