If you go to trial to prove your innonence and found guity can you go to jail or do you still get the plea bargain of 3 yrs probation and the fine?

If you go all the way to the verdict, any plea offers are thrown out the window.

Plea bargains are generally only available before trial. They serve many purposes in our judicial system, but the most significant purpose is to eliminate risk of losing the case. From the prosecutor's standpoint, a plea bargain is counted as a conviction with a negotiated outcome that eliminates the risk of having the defendant (whom the prosecutor believes is guilty) found not guilty for some reason. For a defendant, a plea bargain generally results in a more lenient sentence than if the case is tried and lost. Once a jury reaches a verdict, however, the time for plea bargaining is past. Therefore, if you decide to reject the plea offer and go to trial, you may be convicted and your sentence may be stiffer than that offered in the plea bargain, including the possibility of going to jail, although judges are not supposed to give heavier sentences just because a defendant opted not to plea bargain. You should consult with your lawyer, determine your chances of being convicted at trial, and decide whether to take the plea or not.

Once you turn down the plea bargain , you cannot go back to it if you are found guilty. In addition to the jail time you will still get the fines and probation too! I would not gamble on it myself. "The Justice System" as they call it ,is not always just. Good luck.

If found guilty, and the law permits jail time then yes. If it is a first time offense then you may get lucky. I would ask and lawyer to make sure, this is not something you want to gamble with. If you are innocent then seek legal help ASAP !

If found guilty it's go to Jail, go straight to Jail and don't pass go!
