This remember will turn on a pair of key factors. First, how long has ot been when you consider that those transactions occurred? there's a statute of downside in touch. in many situations the value of a element taken and stored is 3 years, at the same time as the statute for an oral contract is two years. If the two of those classes have handed, you may nicely be ok. 2d, if there have been no signed papers or notes governing the words of this transaction, you will have grounds for dispute there. If the words have been meant to take longer than a million twelve months, the contract had to be in writing below the Statute of Frauds. finally, have been there ever any witnesses who ought to testify to those transactions and the words below which they occurred? except there are such witnesses, or some written memorandum of the deal that should take the case out of the Statute of Frauds, he's going to have a problematical time proving his declare. What this sounds choose for to me is that he gave you those money when you consider which you all have been a pair, and now which you have broken up with him, he's going to be vindictive and attempt to get it back. another element, you should produce receipts (in case you have them) for what you used the money that he gave you as evidence that the money have been help and not loans. in case you weren't employed on the time that must succeed additionally because of the fact it may help the thought that he substitute into assisting you out in a time of choose for.

If they were ALL gifts then he has no claim to them.
But whats tricky is what constitutes a gift.
Have you been served w/ a summons and complaint?
You should reply to that and say that there was no consideration-- meaning that you didn't give him anything in return for the gifts, so it was not a contractual obligation for you to give anything in return or return the items. Gifts are yours to keep unless he had provisions when giving them to you.
Try and find a lawyer that only requires you to pay if you win.
Good luck!

Thanks god that you have left him. This guy is just childish and narrow-minded. Well, it all depend what gifts you are talking about. If its a valuable property such as houses or car, he will need to prove he brought them and it's for your temporary possession. He can't sue you, the most he will get back the "gifts" he gave to you. You don't need to do anything, just go to infront of the magistrate and tell the truth.

When I watch the judge shows on TV, the people that sue for "gifts" dont get anything. thats what they are, gifts. If you signed a letter saying that you owe him money, or that they werent gifts your in trouble. but other then that you should be fine. how much did he give you?

I think he can't sue you unless there is conflict of interest where he give you the gift in return of some other favours from you.

Tell him to go ahead and take you to court. They won't make you pay for or give back "gifts" assuming they were actually given as a gift.

Just a lesson learned: Not to take someone gift when you are unsure of your love to him.

If they were gifts, they are yours. But if having them around just reminds you of what a jerk he is, maybe you can sell them or give them back to him.
