They can run their store however they see fit. Minors SHOULDN'T be in a place that sells alcohol and cigarettes late at night. In fact, minors are supposed to be at home by then, anyway.

A business has the right refuse service to any one if it is not violating there civil rights and I don't think a civil rights violation has occurred

Not sure that is legal. Call the office of the Attorney General in your state and ask them if the shop owners can do such a thing.
I think if you have a public shop you have to let the public in the shop
